Arizona is a At-Will Employment state. Employers have the "Right" to terminate
employees unless...

"both the employee and the employer have signed a written contract to the contrary
setting forth that the employment relationship shall remain in effect for a specified
duration of time or otherwise expressly restricting the right of either party to terminate
the employment relationship." (ARS 23-1501)

Wrongful termination lawsuits are possible in an "at-will" employment state.

  1. Termination is always traumatic -- it should never be a surprise.
  2. Restate the problem and consequences.
  3. Document incidents and training provided.
  4. Have the employee restate the above.
  5. Tell the employee they are terminated.
